Une facture électronique est une facture émise, transmise et reçue sous une forme dématérialisée et qui comporte nécessairement un socle minimum de données structurées, ce qui la différencie des factures « papier » ou des PDF ordinaires. Par ailleurs, les factures au format PDF seront admises à titre transitoire jusqu’au 31 décembre 2027, au profit de formats électroniques standardisés (UBL, CII, Factur-X).

Les factures transmises par voie électronique ne sont valables qu’à condition que l’authenticité de leur origine (émetteur identifié), l’intégrité de leur contenu (non modifiable) et leur lisibilité soient garanties.

Trois acteurs jouent un rôle essentiel dans le cadre de ce dispositif (schéma en Y). Les entreprises assujetties à la TVA auront le choix de :

Se raccorder directement au Portail Public de Facturation (PPF). Il aura pour rôle de centraliser les échanges de factures et de transmettre les données de facturation en temps réel à l’administration fiscale.

Ou de passer par des plateformes privées :

Les Plateformes de Dématérialisation Partenaire (PDP) qui seront immatriculées auprès de l’administration fiscale. Elles seront habilitées à transmettre directement les factures électroniques aux destinataires et à partager les données avec le PPF.

Les Opérateurs de Dématérialisation (OD) qui proposent des services à valeur ajoutée (conversion, validation etc.) pour la gestion des factures émises et reçues, en étant combinés à une plateforme (PPF ou PDP).

La réforme de la facturation électronique permettra :

  • L’automatisation du suivi ;
  • La vérification de l’exactitude des factures réceptionnées et le suivi des informations de la facture grâce au contrôle des factures fournisseurs (quantité, prix, montant, TVA, description, etc.)
  • Une gestion plus efficace de la trésorerie et des finances de l’entreprise en suivant le cycle de vie d’une facture et les délais de paiement.

La non-émission d’une facture au format électronique implique une amende forfaitaire de 15 € par facture avec un plafond de 15 000 € au titre d’une année civile. Quant à l’e-reporting, le non-respect de cette obligation sera sanctionné d’une amende de 250 € par facture, dans la limite de 15 000 € par an.

Quel que soit le mode de dématérialisation choisi :

  • Les factures doivent être conservées dans leur format d’origine, tel qu’elles ont été émises et transmises par leur émetteur.
  • L’authenticité, l’intégrité et la lisibilité des factures doivent être garanties dès leur émission et pendant toute la durée de conservation requise.
  • L’obligation de conservation s’étend à l’ensemble du contenu de la facture, y compris les mentions non obligatoires.

Les documents doivent être archivés de manière bilatérale, à la fois du côté de l’émetteur et du côté du destinataire. Pour le fournisseur, il devra conserver la facture émise par lui-même ou celle émise par toute autre personne en application d’un mandat de facturation (plateforme partenaire, OD). Pour le client, il devra conserver la facture au format reçu par sa plateforme.
